Trial court properly denied appellants' motion for judgment notwithstanding the verdict where the facts support jury findings that the insured intended to tackle appellant but that he did not intend to injure him. 2. Where an insured committed an allegedly tortious and nonconsensual act, the trial court did not err in instructing the jury that the term ""accident"" in the homeowner's insurance policy is an ""unexpected, unforeseen, or undesigned happening"" and that it includes negligently caused injury, provided such injury was not intentional; the special interrogatory was adequately framed to ask whether the wrongful or tortious act or event was an accident.
